The Personal Data protection and confidentiality are subjects that Merck takes very seriously; therefore, Merck always acts according to the applicable European, international and/or domestic regulations with regard to personal data protection. Therefore, with this statement about Personal Data protection measures, Merck wishes to provide you all the information about the type of data that Merck and its affiliate companies wish to store and, in its case, inform you about how this data will be used.
Storage and use of dataAs User of our Portal, you shall remain anonymous. The data that Merck stores and analyzes are Dissociated, and are only used for statistical purposes, e.g., in order to guarantee a continuous improvement of our services, measure the contact levels with patients, health professionals, etc. The data that is stored in Merck’s server are the Internet service supplier name, the web page from which you have visited us, the web pages of Merck that you have visited, your IP address, date and duration of your visit.
Collection and Management of Personal DataMerck only collects and stores Personal Data if you use specific services and only if you have voluntarily provided your express consent. You can do this, for example, as part of a registration procedure, completing a form or sending an e-mail, requesting the information about products or services, by sending a question or requesting materials. Unless that other legal provisions are applicable, Merck shall only use your Personal Data for the goals for which you have provided your consent.
The Personal Data that you eventually provide to Merck shall be treated with the only objective to maintain the relationship established with Merck, which include the service procedures, management, rendering, extension and improvement that Merck provides, registration or using the adjustment of such services to your preferences, the study of the use of services by the Users, the design of new services related with those already offered by Merck, the sending of service updates, the sending, by traditional and/or electronic means, of technical, operative and commercial information about products and services offered by Merck and/or third parties, at this time or in the future. The objective of the collection and management of Personal Data also includes the sending of poll questionnaires, which the User is not bound to answer.
Your Personal Data shall be treated, at all times, in a legal manner and respecting the Principles of Consent, Information, Quality, Objective, Loyalty, Proportionality and Responsibility in accordance with that set forth in the Act, we shall not share it with third parties, unless you have provided your consent for such effects or unless it has been ordered by the competent authorities. In the event that Merck, with your consent, transfers your Personal Data, shall assure that the persons to which this data is transferred process your Personal Data for the same objective for which it has been collected by Merck and shall have an adequate data protection obligation level.
Data storageMerck stores your data only during the time period required to carry out the service you have requested.
In addition to the foregoing, Merck informs you that, for any reason and under any circumstance whatsoever, Merck stores Sensitive Personal Data in the Portal; as such term is defined in Subsection VI of Article 3 of the Federal Act for the Protection of Personal Data in Possession of Individuals.
Right of Access, Rectification, Cancellation and Opposition.The holders of Personal Data in possession of Merck have acknowledged and may exercise, at any moment, the rights of access, cancellation, rectification and opposition, by contacting Merck, to the contact data specified below.
The access, rectification, cancellation or opposition request shall include and attach the following: : (i) name and domicile or e-mail of the Holder in order to inform the answer to your request; (ii) the documents which support the identity of the Holder, or, if applicable, the legal representative who acts on his/her behalf; (iii) a clear and precise description of the Personal Data with regard to exercising any of the aforementioned rights; (iv) any other element or document that facilitates the location of your Personal Data; (v) clearly specify whether the request is for access, rectification, cancellation or opposition; (vi) the reason for your request; and (vii) the modifications to be performed in the event that the request is for rectification of Personal Data. Once the request has been performed, Merck shall inform you, in a term no greater than twenty (20) calendar days counted as from the date of request receipt, the determination adopted, and, in the event it may proceed, it shall be effective within the next fifteen (15) calendar days after the proceeding is informed to you. The foregoing is on the understanding that the aforementioned terms may be extended one time, when the particulars of the case so deserve at Merck’s consideration.
Safety and protection of dataMerck has adopted safety protection measures for Personal Data legally required, and shall install all other media and additional technical measures in its scope to avoid the loss, misuse, alteration, non-authorized access or theft of the Personal Data provided by the User. Notwithstanding the foregoing, and since the safety measures may be susceptible of violations by acts out of the control of Merck, Merck, without any liability, commits itself to inform the User in the event of violations to its safety measures, in order that the User may take the measures corresponding to the defense of his/her rights.
Information collection by third-party web pagesThe Portal includes links to other web pages whose information practices may be different to those of the Portal. In the event of visiting other sites, the User is responsible to check the privacy conditions of such web pages. Merck, in no event and under any circumstance shall be responsible for the Management that other web pages different to the Portal shall provide to the Personal Data of the User.
